ENERAL TERMS AND CONDITIONS OF SALE
PURPOSE
These terms regulate the booking of stays at the vacation homes (CAV) managed by Gerale Srl, with registered office in Brescia (Via Sardegna 12D, VAT number 02539920203, REA BS-582407), email: [email protected], and govern any services purchased through the company (hereinafter "Gerale Srl") and the interested customer (hereinafter Guest).
1. APPLICATION
These conditions apply only to bookings made directly through the websites www.gerale.com or www.gheb.it, or via email to [email protected]. The customer accepts these conditions on their behalf and for any third parties benefiting from the service.
2. PREMISE
These conditions are part of the tourist lease agreement between Gerale Srl and the customer.
3. ASSISTANCE OBLIGATION
Gerale Srl guarantees assistance during the booking, stay, and until check-out. It is not responsible for activities outside the stay, even if promoted on the websites.
4. BOOKING
Bookings can be made:
• Through the "Contacts and Reservations" section on our websites.
• By sending an email to [email protected] with the required details.
Maximum duration of stay: 29 nights.
Minimum duration: variable.
5. PRICES AND RATES
Prices are expressed in euros, inclusive of VAT, and vary based on the property, period, number of guests, and duration of stay. They include basic services (water, electricity, internet) but do not include tourist taxes, food, drinks, or extra services.
6. VALIDITY OF OFFERS
Offers are valid until 24:00 on the date indicated in the offer.
7. CONFIRMATION OF BOOKING
The booking is considered confirmed only after:
• Acceptance of the quote via the provided link and simultaneous acceptance of these sales conditions.
8. PAYMENTS
Accepted payment methods:
• Bank Transfer
• PayPal
• Credit/debit card via the GuestPortal system – Satispay
9. ARRIVALS AND DEPARTURES
• Check-in: from 14:00.
• Check-out: by 11:00.
Different times must be agreed upon in advance.
10. SUPPLEMENTS AND DISCOUNTS
Supplements and discounts vary depending on the property, period, and sales strategies adopted by Gerale Srl. These details will be indicated in the offers.
11. ACCOMMODATIONS AND NUMBER OF GUESTS
The maximum number of guests is as indicated for the property.
• Infants (0-3 years): stay free of charge but must be declared at the time of booking and possess a valid ID.
• Extra guests: incur a supplement per person per night if not declared at the time of request.
12. CHANGES TO THE CONTRACT
Changes to the booking must be approved in writing by Gerale Srl. Changes do not incur costs, but the customer accepts any price variations.
13. CANCELLATION AND PENALTIES
• Refundable Rate: Full refund for cancellations made more than 7 days before check-in.
• No refund for cancellations made less than 5 days before check-in.
• Non-Refundable Rate: No refund in case of cancellation. This rate must be selected by the customer and requires 100% payment at the time of confirmation.
14. SUBSTITUTIONS
The customer can be replaced by another person by notifying Gerale Srl at least 4 days before check-in.
15. UNAVAILABILITY OF THE PROPERTY
In the event of unavailability of the property due to force majeure, Gerale Srl will refund 100% of the amount paid, verifiable through tracked payments (Bank Transfer, PayPal, Card via GuestPortal).
16. TOURIST TAX
The tourist tax is not included in the prices and must be paid electronically at online check-in. It varies depending on the location and time of year, according to municipal regulations. The list of exemptions is displayed in each property.
17. CUSTOMER (GUEST) OBLIGATIONS
The customer must maintain the property in good condition and report any damages.
They may not sublet the property or organize events/parties without permission.
18. LIABILITY FOR THIRD-PARTY SERVICES
Gerale Srl is not responsible for services offered by third parties, even if advertised on its websites.
19. COMPLAINTS
In case of service issues, the customer is invited to contact Gerale Srl during the stay for a timely resolution.
20. CONTINUOUS IMPROVEMENT
Customers are encouraged to provide suggestions and complete a satisfaction questionnaire at the end of their stay.
21. ADDITIONAL DOCUMENTATION
The customer must read and accept the "house rules" before booking.
The customer accepts any penalties resulting from non-compliance with the "house rules."
Gerale Srl is required to leave a copy of the house rules at each property, accessible to the customer during their stay.
The customer accepts that the "house rules" may be modified even after booking.
22. DISPUTES
For any disputes concerning the execution of this contract, the exclusive jurisdiction of the Court of BRESCIA is agreed upon by the parties.
23. PRIVACY
Information pursuant to Legislative Decree 196/2003 (Privacy)
Gerale Srl informs that personal data concerning the customer and the users of the stay are processed at its offices, consisting of: name, surname, place of birth, residence address, telephone numbers, email addresses, identification document, selfie with identification document. This data will be stored in specific paper and computerized archives; only processing strictly necessary for the execution of administrative formalities, mandatory legal obligations regarding public safety, and ISTAT will be carried out. Providing this data is optional, but refusal will prevent the execution of the contract. Therefore, the customer and the users of the stay GIVE consent to the processing of their personal data as specified in the above information, as well as to publish any reviews on Gerale Srl's communication and marketing channels (Facebook, Instagram, website, Google My Business, etc.) always in anonymous form or as provided by booking platforms.
Pursuant to and for the purposes of Articles 1341 and 1342 of the Civil Code, the customer expressly declares to approve the following clauses: 1-2-3-4-5-6-7-8-9-10-11-12-13-14-15-16-17-18-19-20-21-22-23.
