This document called "General Terms of Sale" is intended to be a clear negotiating tool between the customer who wants to book a stay for themselves or third parties at a holiday home "CAV" managed directly or indirectly by Gerale Srl.

Application
These rules apply only to bookings known as "DIRECT" or made by the www.gerale.com www.gheb.it site or in any case without brokering other platforms called "OTA".
The General Terms of Sale are effective for the contractor of the stay who is committed to accepting them and includes any third parties who use the service, in any absence will also personally respond to the latter.
Premise
The following General Terms of Sale are an integral part of the tourist lease between Gerale Srl based in Brescia - Via Sardegna 12D - and better identified with VAT Number IT 02539920203 and the Customer.
SERVICE OBLIGATION
In relation to the obligations to the Customer, they are obliged to take the measures imposed by the professional diligence criterion.
Gerale Srl Limited when booking, during their arrival and throughout their stay until the time of check-out.
Gerale Srl. is not required to assist with the extra activities during the stay, purchased by the customer even if sponsored on the website www.gerale.com www.gheb.it
1. BOOKING AND CONTRACTING
The customer who decides to make a booking request can proceed directly from our website www.gerale.com www.gheb.it in the following ways:
Of their own volition by accessing the "contacts and bookings" section http://www.gerale.com/contacts-and-reservations/
Sending an e-mail directly to Gerale srl ([email protected]). Mandatory with the following information: the applicant's first and last name, the name of the property, the period of interest, the number of guests, the presence of children and/or infants, the presence of any pets and any additional requests. Based on the information provided, Ltd. will send the customer a quote, state if the property is unavailable, or propose an amendment to the dates.

š« Minimum stay time: Variable by accommodation and period.
2. PRICES AND RATES
Prices posted on the www.gerale.com or www.gheb.it website are:
Always expressed in Euro
They always include VAT
Active, therefore variable in consideration of the following factors: the type of structure, the selected period, the number of guests present, and the duration of the stay.
They always include: Access to the structure and common areas of the facilities (if present such as swimming pool, tennis courts, etc ), Electrical Energy, Gas, Heating, Air Conditioning, Water (both cold and hot), Internet, Kitchen accessories (cookware pots, use of washing machine service appliances and Dryer, if available ), 1 Set per room of Chamber linen ( mattress cover, pillowcases, blankets or duvets and 1 Set of bath linen (1 shower towel, 1 face towel and 1 guest towel ) in some cases it also includes the supply of beach towels.
š« The price does not Include The Stay Tax, Food and Drink, Extra Services, Transportation and Unspecified supplements for pet costs.
Prices to be considered valid and binding are:
Those indicated in the quotes/offers issued as a result of the Customer's request and related to the information received.
Those visible on the website at the time the customer concludes the booking.
3.VALIDITY OF OFFERS
Offers/quotes are always valid until 24:00 (midnight) on the day after the date on the document, text message, email, or any paper or computer tools Srl uses to communicate with the customer.
4.BOOKING
The booking is considered confirmed only after:
The customer accepts the quote sent and in the terms set out of validity
Accept General Sales Terms
They take a look at and accept the "rules of the house"
The customer corresponds to Gerale srl the amounts 100% advance payment (unless different deposit and balance agreements are indicated in the offer)
š« Failure to comply with the terms listed above and especially regarding the payment of the down payment and/or balance, will be considered a breach of contract and therefore will automatically authorise srl to make the booking void.
In particular, the failure to make the above payments on the dates established constitutes an express termination clause of the contract, which would determine its resolution.
Upon receipt of each on-account payment or Gerale Srl balance, the company will send the customer an Invoice with the quote entries listed.
ā ļø Gerale Srl invites customers to thoroughly check the information contained in the Invoice, in order to ensure compliance with the contractual conditions required and report in writing by 24:00 (midnight) the next day with any comments.
5. PAYMENT MODE
Gerale Srl accepts the following payment methods:
Bank Transfer
Paypal
Credit card or ATM (only at the property)
Satispay
š« Gerale Srl, does not accept cash payments except the Stay Tax.
6. ARRIVALS AND DEPARTURES
The booked accommodation is always available to customers from 14:00 on the day scheduled at Check-in.
The property should be left free and in order no later than 14:00 on the day of check-out.
Any arrivals and departures at times other than those indicated must be requested at the time of booking or reported before arrival.
Gerale Srl, reserves the right to accept or not accept such requests and will always confirm them in writing.
7. SUPPLEMENTS AND REDUCTIONS
The surcharges and reductions that srl agrees with the customer:
Are always highlighted in tax documents.
They must always have been sent in writing by Gerale Srl.
They vary by structure.
8. ACCOMMODATIONS AND GUEST NUMBER
Accommodation may be occupied by no more than the number of people indicated in the type of structure chosen.
Infants and children up to 5 years old are calculated as guests, but they stay for free
Each person exceeding the established number, and still not exceeding the maximum capacity, will have to pay the same share paid by the supplement foreseen for extra guests
Failure to pay the above additional fee constitutes a termination clause expressed in the contract without any compensation charge on the part of Gerale Srl. and which will result in the loss of the booked accommodation.
It is always the right to refuse access to the surplus.
Customers are responsible for declaring all those present in occupied accommodations for the purpose of complying with Italian public safety standards.
Customers are required to provide the current recognition documents (including children) in accordance with the law, carefully filling in the online check-in via the link sent by e-mail 4 days before the planned check-in by Gerale Srl.
9. CONTRACT CHANGES
In the case of a request to change the booking confirmation (e.g. dates of stay, accommodation, etc.) this must always be approved by Gerale Srl in written form
The first deviation from the original booking is always free.
š«. for each subsequent variation a cost of 50.00 euros will be applied.
The Customer accepts that with each change it involves a change in the offer, disabeling the previous offer and generating a new one that may differ in terms of price.
Failure to pay change costs and any surcharges represents termination clause of the contract
Requests for variation should always be made through the www.gerale.com www.gheb.it site or alternatively by sending an e-mail request [email protected]
Gerale Srl will always send, in case of acceptance, an e-mail summarising the change at that time and the Customer may consider the change accepted.
10. RIGHT OF CANCELLATION AND PENALTY
Refundable rate:
The withdrawal must be received in writing to Gerale srl by e-mail booking and will be subject to the application of the penalties indicated below:
ā ļø Bookings made under date: (0-5 days from check-in): Upon confirmed booking, no refund will be required.
For bookings made before 5 days from check-in:
ā ļø Cancellation of the reservation at 0-5 days from check-in: the customer pays the total amount of the reservation.

Cancellation of the reservation at 6 or more days from check-in: the customer is entitled to 100% of the refund paid up to that time and-demonstrable.
š Credit refunds are made via PayPal or bank transfer and issue of credit note
The cancellation penalty is calculated on the entire amount of the confirmed booking reduced only by the following extra services if selected:
Final cleaning for pets (if allowed)
Provision of extra linen in addition to the basic weekly
Extra cleaning called "refresh"
Gerale srl will not make any refund in the following cases:
š« the customer decides to stop the stay already undertaken.
š« the customer will not be able to make the trip for lack or inaccuracy of the required travel documents and identity (example: passports, visas and residence permits).
š« the client arrives late due to strikes and difficulties encountered during the trip
š« The Customer or users of the service refuse to provide identification documents.
Gerale srl provides for the refund of 100% amount paid even in case of cancellation "under date" only in these cases:
Natural Disasters at the place of stay refund 100% of the reservation
Epidemics at the area of stay 100% refund of booking
Pandemics declared by the WHO 100% refund of booking
Laws, Decrees, Ordinances imposed by Common Regions or State - refund 100% of booking.
NOT REFUNDABLE RATE
The NON REFUNDABLE rate provides an additional discount compared to the Refundable Rate, this discount indicated during the booking is available at the free choice of the customer, who undertakes to:
- pay 100% of the booking at the time of confirmation
- cancel any refund for the reservation.

11. SUBSTITUTES
The customer is unable to take advantage of the booking (below called a waiver) has the right to apply to be replaced by one or more persons in the following listed as " taking over" under the following conditions:
The change is communicated by an adult in writing and within 4 working days before the fixed date for the employment of the dwellings.

š« The renunciation and replacement client declares acceptance of the financial and legal respects to Gerale Srl. in relation to the contract.
12. THE ACCOMMODATION HAS BEEN UNAVAILABLE
If major forces prevent srl from making the accommodation booked available because it is deemed unusable, or extraordinary maintenance is required, Srl reserves the right to cancel the booking, communicating it to the customer in written form, acknowledging to the customer 100% of the amount paid without the latter being able to make further requests for any title.
In the case of a stay already started, only the remaining day share not used will be paid.
13. STAY TAX
Any residence fees provided by local and/or regional law are never included in the price of the stay indicated in the booking documents sent to the customer.
The residence fee should always be paid in cash at the property or by electronic means of payment
At the time of payment, the customer will receive a non-tax receipt for the customer that certifies the collection by Gerale Srl and the payment made by the customer.
The residence fee is always calculated per night per person, this varies from period and from the area of the accommodation.
14. CUSTOMER OBLIGATIONS AND BANS
The customer and their guests are required to always act accordingly and ensure the property is in good repair, leaving it as you find it. Keeping the property in good condition, to take responsibility for any damage to parts of it that are not attributable to wear and tear or electrical or hydraulic phenomenon.
The customer responds financially directly or through a travel insurance policy that they subscribe to.
In the case of pets, where allowed, the Customer is held responsible for the damage caused by it.
You are obliged to report by e-mail, reporting any involuntary or unseeded break in order to be able to plan and/or intervene in a timely manner to restore or fix it.
The customer is obliged to always provide the total number of those present in the property since the booking.
Failure to declare correctly violates the Public Safety Act and requires the immediate removal of persons, reporting to the relevant authorities.
It is forbidden to sublet the property, partially or totally.
The Customer is obliged to accept and respect what is present in the document "rules of the house" specific to the booked accommodation.
15. RESPONSABILITY SERVICES OF OTHER ADVERTISED FORNITORS ON THE SITE www.gerale.com www.gheb.it
Gerale Srl does not take any responsibility for services offered by third parties even if published on its website. These services are provided and managed directly by third parties and are not in any way an integral part of the service provided by Gerale Srl. So the customer cannot in any case claim compensation from Gerale Srl
16. COMPLAINTS AND RESPONSIBILITY REGIME
Gerale Srl acts as a holiday home manager by offering its customers services provided directly or even by third parties. As such, it cannot be responsible for any kind of damage, delay, omission, serious fault caused directly by the providers that provide the service.
Gerale srl is not responsible for the loss of luggage, theft inside the facilities, damage resulting from terrorist activities, popular riots, strikes, diseases, local laws, climatic conditions, natural disasters or any other action, omission or condition outside of any control.
In any case, srl is only responsible for the final price paid by the customer by virtue of the services rendered expressly excluding all liability for direct and indirect damages or loss of earnings.
Gerale Srl invites customers in case of malfunctions and/or disruptions to contact us during the stay, in order to allow us to intervene as quickly as possible to solve problems.
17.CONTINUOUS IMPROVEMENT POLICY
Gerale Srl will be extremely happy to receive suggestions from the customer, comments and advice that they will want to send at the end of their stay.
The customer agrees to receive an e-mail at the end of the stay.
18. ADDITIONAL DOCUMENTATION
The Customer is required to read and approve unconditionally the "rules of the house" section of each accommodation before their booking.
The Customer accepts any penalties or penalties arising from non-compliance with the " rules of the House "
Gerale Srl is required to leave a copy of the rules of the house at each property, which can be consulted by the Customer during the stay.
The customer accepts that the "rules of the house" can also be changed after the booking.
19.PRIVACY
A statement under D.Lgs. 196/2003 (Privacy) informs that personal data concerning the Customer and the users of the stay is processed at its offices, consisting of: first name, last name, birth address, address of residence, telephone contact details, e-mail addresses, identification document, photos with identification document. This data will be stored in special paper archives and computerised; Only the treatments that are strictly necessary for the execution of administrative formalities, mandatory requirements of the Public Safety and Istat Act will be carried out. The award is optional, but in the event of a refusal, the contract cannot be executed. Therefore the customer and the users of the stay need to consent to the processing of their personal data as specified in the above statement in addition to posting any reviews on the communication and marketing channels of Gerale Srl ( facebook istagram website Google my business etc.) always anonymously.
20. DISPUTES
In any disputes over the implementation of this contract, the sole jurisdiction of the Brescia Forum is between the parties agreed.
According to the terms and effects of Articles 1341 and 1342 Civil Code, the Customer expressly approves the following clauses: 1) PRE-NEWS AND CONTRA STIPULATION; 2) PRICES AND RATES; 3) VALIDITY OF OFFERS; 4) BOOKING; 5) PAYMENT MODE; 6) ARRIVALS AND DEPARTURES; 7) SUPPLEMENTS AND REDUCTIONS; 8) ACCOMMODATION AND GUEST NUMBER; 9) CHANGES TO THE CONTRACT;10) CANCELLATION AND PENALTY;11) SUBSTITUTIONS;12) 14) CUSTOMER OBLIGATIONS AND PROHIBITIONS;15) RESPONSIBILITY FOR THIRD-PARTY SERVICES ADVERTISED ON THE SITE;16) CLAIMS AND LIABILITY REGIME;18) ANCILLARY DOCUMENTATION;19) PRIVACY ;20) DISPUTES
